Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the MyCustoms platform, including any related websites, services, or applications (collectively, the "Platform"). By accessing or using MyCustoms, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
Description of the Platform
MyCustoms is a technology platform that allows users to buy and sell custom videos. The Platform facilitates transactions between users but does not create, own, or control user-generated content. Creators are solely responsible for the content they produce and deliver.
Eligibility
You must be at least 13 years old to use the Platform. Buying videos is available to users worldwide. Due to payment processing requirements, selling videos as a creator is only available to users located in Canada, the United States, the United Kingdom, Switzerland, or a country within the European Economic Area (EEA). By using MyCustoms, you represent that:
- the information you provide is accurate
- you meet the minimum age requirement
- your use of the Platform complies with all applicable laws
- if registering as a creator, you are located in an eligible country
MyCustoms may suspend or terminate access to users who violate these Terms.
User Accounts
Creating an account may require providing information such as:
- email address
- username
- display name
- date of birth
- country
- profile photo
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. MyCustoms may suspend or terminate accounts that violate these Terms or misuse the Platform.
Creators
Users located in Canada, the United States, the United Kingdom, Switzerland, or a country within the European Economic Area (EEA) may become a creator on the Platform. This restriction exists due to payment processing requirements. Creators are independent users, not employees, agents, or partners of MyCustoms. Creators are solely responsible for:
- the content they create
- fulfilling requests they accept
- ensuring their content complies with applicable laws and these Terms
Creators represent and warrant that they have the legal right to create and sell the content they provide.
Orders and Payments
Payments on the Platform are processed through Stripe. When a buyer places an order:
- a temporary authorization may be placed on the buyer's card
- the buyer is charged only after the creator delivers the requested content
If a creator does not deliver an order, the authorization may expire or be released without charge.
Platform Fees
Transactions on the Platform may include the following fees:
- Buyer fee: A 10% platform fee added to the purchase.
- Creator fee: A 4.5% + $0.30 processing fee per transaction to cover payment processing costs.
Fees may change at any time at the Platform's discretion.
Refund Policy
All sales on MyCustoms are final. Refunds are not provided once content has been delivered. If a creator does not deliver an order, the buyer will not be charged.
Content Restrictions
Users may not upload, request, or distribute content that includes:
- illegal activity
- hate speech
- harassment or abuse
- copyrighted material without permission
- adult or sexually explicit content
- any content that violates applicable laws
MyCustoms reserves the right to remove any content at its sole discretion.
Intellectual Property
Creators retain ownership of the content they create. When a creator delivers a video to a buyer:
- the buyer receives a personal, non-transferable, non-commercial license to view the content
- buyers may not redistribute, sell, upload, or publicly share the video without permission
By uploading or delivering content through the Platform, creators grant MyCustoms a limited license to store, host, and display the content as necessary to operate the Platform.
Platform Rights
MyCustoms reserves the right to:
- remove content
- suspend or terminate accounts
- refuse service
- modify or discontinue any part of the Platform
These actions may occur at the Platform's discretion.
Account Termination
MyCustoms may suspend or terminate accounts for reasons including:
- violation of these Terms
- fraudulent activity
- abuse of the Platform
- illegal conduct
Users may also stop using the Platform at any time.
Disclaimer of Warranties
The Platform is provided "as is" and "as available." MyCustoms does not guarantee:
- uninterrupted service
- error-free operation
- that content or services provided by users will meet expectations
Limitation of Liability
To the fullest extent permitted by law, MyCustoms Platforms Inc. shall not be liable for:
- user-generated content
- disputes between users
- indirect or consequential damages arising from use of the Platform
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms will be resolved under those laws.
Changes to These Terms
MyCustoms may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
